As consciousness revealed nature and its variety and the life chain nothing interfered with the primitives except the might which interfered with the meek. As senses saw sense in subjugating themselves to reason and disciplined conduct, humans had taken the first steps toward disciplining themselves and giving to themselves a Religion for human conduct and laying the first foundations for the making of civilizations.
When consciousness associated with
the ego, the mind and the senses, the “being” came into existence along with
nature, and the primitive beings lived the life of birds without any
restrictions on cohabitation. No institution interfered with such cohabitation
or conjugality. Life in its rudimentary customs was one and the same for the
human and the animal. There was rarely any expression of preference as action
responded to urge oblivious of the friction that such caused, and this
continues among the animals even today though the humans now appear somewhat
distinguished.
A lion in a pride as it becomes weaker gets
replaced by the stronger one and no restriction applies to this strong one even
as it deals with the one of which it is born. The urge that drives the strong
and the weak lion is the same and is genetically programmed. The conduct of the
lions in the pride may have a tradition of might but such exercise of might is
not governed by customs and laws that govern the humans which they have given
to themselves through the journey of civilization.
The world of the animals is delineated by a thin
line which separates the humans which had urges and drives similar to the
animals but in contrast to the animals had a distinguishing faculty, the
faculty of reasoning that in time raised them to the level of the ruler who
through his intelligent institutions established what we now understand as “civilizations.”
These civilizations that came into existence had to make a long journey. They
travelled through individuality into the concept of family, society and states
with their laws. The society in their evolved civilized state developed their
customs, traditions, folkways, and mores and in time institutionalized these
into laws that were to be the agents of judgment and enforcement of order.
The institution of marriage is one such
institution that sought to recognize and safeguard cohabitation and accord it
social and legal legitimacy. Frictions within this status, between individuals
were not ruled out hence the societies and law also saw a way out in divorce.
No man however strong can take another’s wife by virtue of his might or
influence with impunity, as an ape, or a lion, or still other animals. It is
the law of any land with civilized people that appreciate and recognize the
aspirations of the people drawn from their feelings and emotions judged on the
crucible of reason which shields the meek from the mighty.
There is light and there is darkness.
There is good and there is bad. There is a majority stand and a minority stand,
there are animal laws made by the human and there are laws made by him for
himself. There are human rights with grey areas allowing practice of inhuman
conduct.
The Supreme Court of India sat on a curative
petition today to decide whether the gays can have the freedom they demand, the
High court having decriminalized the practice. The visual channels of our time
cry hoarse in favor of people demanding a change, the Supreme Court previously found,
a demand of the miniscule. Some men want to marry their sex and some women theirs.
